Building a pier near Cape Hatteras National Seashore

Most of the shoreline south of Nags Head is not for sale, has never been for sale, and is not going to be built on. Cape Hatteras National Seashore is the one fact that shapes waterfront work down the length of Hatteras and Ocracoke, and it is why a pier question from Avon or Frisco is a fundamentally different question from the same one asked in Kitty Hawk. Before any permit discussion becomes useful here, it pays to be clear about who owns the ground and the water in front of it.

The Seashore preserves and protects over 70 miles of coastline, running from Bodie Island down through Hatteras Island and on to Ocracoke. Private structures cannot be built on shorelines the National Park Service administers, which removes the ocean side of those islands from the conversation almost entirely. What is left is the private inholdings — the villages — and the sound-side frontage belonging to them.

That geography is why the villages look the way they do. Avon, Buxton, Frisco, Hatteras and Ocracoke are pockets of private land inside a federal boundary, and their waterfront is on the Pamlico side by necessity rather than by preference. Dock work down here is sound work by definition, on shorelines where the water stays shallow a long way out and the wind decides more about the tide than the moon does.

The most common misunderstanding about federal land is that it displaces state law. Here it does the opposite. The Seashore manages under concurrent jurisdiction and assimilates State of North Carolina statutes, so state rules — the coastal act very much included — continue to apply on seashore-adjacent waters. Proximity to the park adds a layer of consideration. It does not subtract the state one.

The state layer arrives in its usual shape. North Carolina routes coastal work through CAMA major, general, and minor permits, and a private pier off village frontage is normally general-permit territory, with the field visit and the construction window that come attached. Nothing about the Seashore changes which tier you are in. It changes how much land exists to be in a tier at all.

For the ocean side, the general permit is not an option regardless of who owns the lot, since it is not applicable to oceanfront shorelines. Between that exclusion and the Park Service's, a request for an oceanfront pier on Hatteras Island is a question with two independent refusals standing behind it. Owners are far better served asking what can be done on the sound frontage of the same property, which is usually where the boat wanted to be in the first place.

Practically, working down here means long drives, one highway, and a ferry schedule to Ocracoke that structures a crew's day before the tide gets a say. We mention it plainly because it is the part that moves a build calendar and the part nobody writes into a quote. A dock in Frisco is not a harder dock than a dock in Manteo. It is a harder day.

If your property is a village inholding with sound frontage, there is a permit path and it is an ordinary one. If the question is about the ocean side, it is not really a permit question at all — and that is far better heard on the telephone than after a drawing.
